+ Who needs a Will?

You do.

Bottom line: If you’re over 18 years of age, you should have a legal Will. It’s even more essential if you’re married/defacto, have children, or are recently separated.

A Will is a legal document that sets out your wishes for your property and assets after your death. So if you die without a Will, your assets will be distributed according to a legal formula.

+ How often should my Will be updated?

You should update your will whenever there’s been a significant change in your life, including:
-Marriage
-Separation or divorce
-Death of your spouse or another beneficiary
-You have another child or grandchildren are born
-Adoption
-Incapacity or death of your executor
-Buying or selling significant assets

+ What is an Enduring Power of Attorney?

You can appoint a person as an Enduring Power of Attorney to manage your assets and finances if you are unable to do so yourself due to an accident, medical condition or your absence. It goes without saying that this is a very important detail to cover once you’ve split the sheets with your spouse.

+ What about Guardianship of my children if I die?

In your Will, you can let your executors know who you want to appoint a guardian for children under 18.

Your children are the most precious people in your life, so their care is of the utmost importance. If one parent dies, the surviving parent will usually become the guardian of the child, unless this isn’t in the child’s best interest. However, if both parents die, the child will be cared for by the guardian you have appointed.

If you don’t appoint a guardian for your children, a Court may make the final decision on who your children live with. You need to think about this so that when you’re gone, your affairs remain peaceful.

+ What is Enduring Guardianship?

An Enduring Guardian is someone you appoint to make lifestyle, health and medical decisions for you when you are not capable of doing this for yourself. Your Enduring Guardian may make decisions such as where you live, what services are provided to you at home and what medical treatment you receive.

An enduring guardianship may never come into effect. It is only required if you lose capacity. However, appointing an Enduring Guardian gives you security and peace of mind that if you are unable to make decisions for yourself, this can be done by someone you trust.
